Wildlife Marketplace (Pty) Ltd ("we", "us", the "responsible party") processes your personal information in accordance with the Protection of Personal Information Act 4 of 2013 (POPIA). This notice is provided under section 18 of POPIA.
Your live selfie and face-match result are special personal information under POPIA s26. We process this information on the s27(1)(b) basis that the processing is necessary for an obligation imposed by law (FICA s21 CDD). You may withdraw consent at any time but withdrawal will prevent you from bidding on auctions.
We use Smile ID to perform identity verification (HANIS match, liveness / presentation-attack detection, face match). Smile ID operates outside South Africa; your data is transferred to them under the section-72 cross-border rules with appropriate safeguards (Standard Contractual Clauses).
FICA s22 requires CDD records to be retained for 5 years from the end of the business relationship. CPA auction regulations require bidders' records for 3 years. We retain KYC and auction data for 5 years. Transactional payment data is retained for 5 years per tax legislation.
Under POPIA you have the right to access, correction, and deletion of your personal information (subject to legal retention obligations), and to lodge a complaint with the Information Regulator at inforegulator.org.za.
